    Definitions.  

    The party whose name appears after the heading "sold to" on the (documents) of packing list and/or invoice "customer" from Cobble San Francisco Int'l Co. product(s) listed on the (documents) of packing list and/or invoice.

     

    Acceptance.  

    Seller agrees to sell the product(s) upon the terms and subject to the conditions contained in the above mentioned documents. Customer shall be deemed to have agreed to all terms and conditions contained in the documents of packing list and/or invoice.

     

    Opening a new account.  

    New customers are advised that your first year orders will be shipped only after we receive a cashier's check or cash wire transfer through our bank.

     

    Purchase price.  

    The customer shall agree to pay the total purchase price, including shipping and handling. If any, as specified on the documents and any sales or other taxes levied on or measured by such purchase price, or arising from the use of the product(s) and any parts or maintenance supplied, including, without limitation, any additional sales, use, gross receipts, privilege, excise, and personal property taxes unless otherwise specified in writing on this documents.

     

    Shipping and delivery.  

    Orders will be shipped out accordingly based on availability of the product(s).

     

    Title and risk of loss.  

    Title and risk of loss or damage to the product(s) shall pass to the customer upon delivery to the carrier at shipping point. Any claim resulting from product(s) damaged in transit, shortages received or tampering must be filed with the carrier by customer.

     

    Inspection.  

    The customer shall inspect the product(s) on delivery and shall notify seller of any defects or discrepancies in the product(s) within 72 hours of receipt. Defects in equipments must be reported and the defective items returned for exchange within 72 hours of original receipt. For local delivery, claims for discrepancies will be accepted only at the time of delivery.

     

    Limited warranty (a). for equipment(s) only:  

    Cobble San Francisco Int'l Co. warrants its "equipment(s)" to be in working condition and free from defects in materials and workmanship for a period of one (1) year from the original invoice date unless specified otherwise. During the first year, Cobble San Francisco Int'l Co. will replace or repair part(s) which proves to be defective. From the second year, at client's own cost, Cobble San Francisco Int'l Co. will only repair equipment(s) which proves to be defective. However, Cobble San Francisco Int'l Co. will not warrant any equipment(s) which have been subjected to additional freight handling/shipping, abuse, neglect, or unauthorized repair or installation. The warranty will not cover equipment(s) installed with non- Cobble San Francisco Int'l Co. components or product(s) with broken warranty seals or assembly trace. After replacement of rma, Cobble San Francisco Int'l Co. reserves the right to request the total cost of the replacement equipment(s) or the equipment(s) itself if later found to be physically damaged by the customer. Customer shall bear all responsibility for shipping charges and risk of loss or damage during transit to seller. This warranty does not extend beyond the original customer. This warranty is in lieu of any other warranty, express or implied. Seller makes no other warranties, express or implied, including any warranty of fitness for a particular purpose or of merchantability. In no event shall seller be liable for indirect, special or consequential damages such as loss of profits or business opportunities, and in no event shall seller's liability exceed the purchase price of the equipment(s). Cobble San Francisco Int'l Co. is not responsible for any repair or service costs incurred by customer, whether or not the item is under warranty. The warranty does not apply if the product is modified or changed without prior written approval from seller. Claims by purchaser due to product failure are limited exclusively to the right of replacement of such defective product or repayment of the sale price. In no case shall seller be liable to the purchaser or any third party for any direct, indirect, incidental, punitive, consequential or special damages.

     

    Limited warranty (b). for "cosmetic product(s)" only:  

    Cobble San Francisco Int'l Co. warrants its product(s) to be in working condition and free from defects in materials and workmanship for a period of two (2) years from the original invoice date unless specified otherwise. During this period, Cobble San Francisco Int'l Co. will replace product(s) which prove to be defective. however, Cobble San Francisco Int'l Co. will not warrant any product(s) which have been subjected to additional freight handling/shipping, abuse, and neglect. After replacement of rma, Cobble San Francisco Int'l Co. reserves the right to request the total cost of the replacement product(s) or the product(s) itself if later found to be physically damaged by the customer. Customer shall be responsible for all shipping charges and risk of loss or damage during transit to seller. This warranty does not extend beyond the original customer. This warranty is in lieu of any other warranty, express or implied. Seller makes no other warranties, express or implied, including any warranty of fitness for a particular purpose or of merchantability. In no event shall seller be liable for indirect, special or consequential damages such as loss of profits or business opportunities, and in no event shall seller's liability exceed the purchase price of the equipment(s). The product is also under warranty for a period of 3 years providing the storage instructions are adhered to.

     

    Storage instructions:  

    Avoid dampness, high-temperature, and exposure to sun light. If the product will be kept in storage for a long time it is recommended that it be stored in a refrigerated place.

     

    Certified Organic Skin Care Characteristics  

    1, Cobbles鈥 organic skin care products contain a large amount of natural essences from plants, for example: essence of aloe. While in use of the liquid products, such as essence or toner etc. if used too much at one time it may produce a slight sticky feeling, so be sure to use a small amount each time to prevent this feeling.

    2, Organic skin care products鈥 color may vary according to the seasonal effects on the plants. While in use of Cobbles鈥 Certified Organic Skin Care, the products鈥 color may change from time to time. Please note, this is a natural condition for organic products and unavoidable, thus, you should not worry about the quality.

    3, Some of our products formula may contain natural plant fibers. Don鈥檚 be surprised, and again, this is natural condition.

    4, Liquid products, such as Essences and toners may accumulate sediment at the bottom of the bottle, and some of the other ingredients could separate, this too is a natural condition, please shake well before use.

    5, Cobbles鈥 organic products are perfectly safe, nevertheless, there are some people if they are allergic to some kind of flowers or grass, then this kind of person may have the same reaction while in use of our products. Only a few have had this happen.

    6, All above mentioned organic products special properties are assured to not have an affect on their quality or results.

    Eco-cert of France has defined a set of standards for natural organic makeups: Eco-cert ECO and Eco-cert BIO, Eco-cert BIO is the highest authentification standard. We, Cobbles鈥 Organic Skin Care products have far exceeded these standards. Eco-cert BIO requirements for makeup needs only to be made up of 10% certified organic ingredients, while most of Cobble鈥檚 organic skin care products are 90% certified organic ingredients or higher, the high standards lead us to high quality.

    Note:
    1銆丒co-cert ECO standard requires that 95% of the ingredients should come from natural plants, within this amount, 5% needs to be certified organic ingredients, while 50% needs to be organic ingredients.

    2銆丒co-cert BIO standard requires that 95% of the ingredients should come from natural plants, within this amount, 10% needs to be certified organic ingredients, while 95% needs to be organic ingredients.

    Alternation, modification and attachments.  

    Any modifications, additions, improvements or attachments to the equipment(s) and/or product(s) not authorized in writing by Cobble San Francisco Int'l Co. shall be solely at the buyer's own expense and risk. if operation of the equipment(s) is affected in any way by alternations, improvements, modifications or installation or attachments, the warranty shall be deemed waived by the customer, and Cobble San Francisco Int'l Co. shall have no further obligation to the customer.

     

    Merchandise return procedure and policy.  
    Should equipment(s) and/or product(s) fail during the warranty period, certain procedures should be followed in order for Cobble San Francisco Int'l Co. to serve the customer efficiently.

    (1)
    Call or e-mail to the customer service department at Cobble San Francisco Int'l CO. to obtain a return merchandise authorization (rma) number. Rma number will be void if defective merchandise has not been received by Cobble San Francisco Int'l Co. within "ten (10) days (u.s.)" "30days (other countries)" after a rma number is issued. Walk in customers without pre-issued rma numbers will not be served. If there are more that three (3) items to be returned, the customer must fax rma request to Cobble San Francisco Int'l Co.. Any merchandise without a rma number will be refused.

    (2) The following must be available for a rma number:
    1 Invoice date
    2 Product description and serial number
    3 Invoice number
    4 Detailed explanation of reason for return

    (3)
    Cobble San Francisco Int'l Co. reserves the right to return any product not repaired, without notification, if the customer ships a product to Cobble San Francisco Int'l Co.'s rma department without original parts installed and/or original products packaging by Cobble San Francisco Int'l Co.

    (4) Requirements for rma processing:
    1
    Returned shipments must be pre-paid, insured and rma number clearly marked on the shipping label and mailing box.
    2 Attach a copy of the original invoice with item and serial number circled.
    3 A detailed note describing all problems.
    4
    All returned equipment/products must be packed in the original packaging and include all relevant material such as catalogues, manuals and accessory items. Improper packaging may void warranty.

    The customer who fails to comply with the above requirements will delay rma processing and may incur service charges. Replacement or repair will be made as soon as returned merchandise is received. Advance replacement will be made upon request at Cobble San Francisco Int'l Co.'s discretion.

     

    Refund policy.  
    The following refund procedures should be followed:
    (1)
    All sales returns must be processed through customer service department. An rma number will be issued for credit returns.
    (2)
    To receive credit, product(s) must be returned within "thirty (30) days" from the received date subject to 20% restocking fee.
    (3)

    Any returned merchandise will not be accepted unless it is unused, undamaged, clean, resalable, and otherwise in new condition, and must follow Cobble San Francisco Int'l Co.'s return procedure as described.

    (4)
    All shipping and service/labor charges are non-refundable. In addition to restocking fees. Cobble San Francisco Int'l Co. will assess an appropriate fee to be deducted from the resulting transaction for any incomplete or customer-damaged return, if Cobble San Francisco Int'l Co. has accepted the item, subsequent return by the customer of items determined to be missing from the original re-shipment will not be accepted. Cobble San Francisco Int'l Co. will calculate the additional charges and the resulting transaction will be regarded as final.
    (5)
    All special order items or (oem) are non returnable & non refundable. A 50% deposit is required for special order items (oem); this deposit is non-refundable.
    (6)
    90% refund within (7) days on Cobble San Francisco Int'l Co. box only.
    (7)
    Between 8 to 30 days following purchase, returned items will incur a 20% restocking fee.
    (8)
    No returns or refund will be accepted beyond (30) days.
    (9)
    Allow fourteen (14) days to process refund.

     

    Damage on arrival (doa).

     
    For all doa equipment(s) and/or products, the customer is required to call for a rma number within 72 hours of the receipt date.


    Lead-time of service.  

    All replacements are subject to stock availability and will be handled within 72 hours (Mon to Fri only the customer is responsible for the difference of the freight charge if the shipping instructions require an express delivery. The charge will be collected on delivery (c.o.d.) Cobble San Francisco Int'l Co.'s hourly labor rate is $60.00 (minimum of 15 minutes)

     

    Cancellation & unauthorized returns.  

    If customer purports to cancel its order, wrongfully refuse to accept the equipment(s) and/or product(s) or return the equipment(s) and/or product(s) without legal excuse. Customer shall pay to seller (Cobble San Francisco Int'l Co.), as liquidated damages and in lieu of enforcement of this contract, a sum of 15% of the sales price and, if shipment has been made. Customer shall also reimburse seller for all shipping and handling fees of shipment. Notwithstanding the foregoing, if customer attempts to return the equipment(s) and/or product(s) without legal excuse, Cobble San Francisco Int'l Co. may in its discretion, refuse delivery and pursue its remedies, there under and under applicable law, which shall include, for example, the right to file a legal action against customer for the full purchase price and incidental damages suffered by the seller.

     

    Limitation of liability.  

    Cobble San Francisco Int'l Co. shall not be liable for damages to the customer for any delay in performance to make timely delivery or failure to perform such as, but not limited to loss of anticipated profits or benefits, in whole or in part, when due to labor dispute, strike war or act of war (whether an actual declaration is made or not), insurrection, riot, civil commotion, act of public enemy, accident, fire, flood, act of any government authority, judicial action, the lack of or inability to obtain war materials or unavailability of parts, labor fuel, electrical power, water or supplies, or other act of god, or similar causes beyond the reasonable control of Cobble San Francisco Int'l Co., which cause or hinders the manufacture or delivery of product(s).

     

    Payment term.  

    The total amount of the invoice shall be payable in full by the customer according to the payment terms shown on the document(s). All amounts past due are subject to late charge and interest at eighteen-percent (18%) per annum or one and one-half percent (1.5%) per month or (0.05%) per day, until Cobble San Francisco Int'l Co. has received payment.

     

    Security agreement.  

    Cobble San Francisco Int'l Co. shall have the right to obtain possession of, and shall have a security interest in, all customers' property in its possession and shall have a purchase money security interest and right of possession in goods already shipped. In the event of a default in payment by customer, seller may take possession of the product(s) on customer's premises or elsewhere, and all rights of action for trespass or other cause are waived. Buyer shall cooperate in whatever manner necessary to perfect said security interest and hereby grant cobble San Francisco Int'l Co. power of attorney to sign any documents necessary for such purpose in the event of customer's refusal or failure to do so.

     

    Attorney fees.  

    If any action at law or in equity is necessary to enforce or interpret the terms or condition of sales between customer and seller, the prevailing party shall be entitled to recover from the non-prevailing party all reasonable attorney's fees and necessary disbursements in addition to any other relief to which that party may be entitled, whether such judgments are prosecuted to judgment or not. This provision shall be construed as applicable to the entire contract.

     

    Collection fees.  

    The customer shall pay Cobble San Francisco Int'l Co. costs and expenses to the collection of any sum due. including overhead allocated to employee efforts, late payment, legal fees and expenses.

     

    Entire agreement.  

    This document set forth the entire agreement between the customer and Cobble San Francisco Int'l Co.. It is intended as a complete and exclusive statement of the terms used in this agreement and no course of prior dealings between the parties and usage of the trade shall be relevant to supplement or explain any item used in this agreement. No agent, employee, or representative of Cobble San Francisco Int'l Co. has any authority to bind Cobble San Francisco Int'l Co. to any affirmation, representation, or warranty concerning the product(s) sold under this agreement, unless the same is included within this written agreement. This agreement may be modified or rescinded only by a written instrument signed by the parties hereto or buy their duly authorized agents. Waiver by Cobble San Francisco Int'l Co. of any provision hereof in one instance shall not constitute a waiver as to any other instance.

    Advertised prices do not include shipping charges or applicable sales tax. Prices are subject to change without notice. Components compatibility is not guaranteed. No return on used items. Cobble San Francisco Int'l Co. is not responsible for any typographical photographic or technical errors. All raised disputes shall be determined in accordance with the laws of the sate of california. Any legal action or proceeding shall be brought and maintained in state court in santa clara country, california. If any provision of this agreement is held by a court of competent jurisdiction to be invalid, void, or enforceable, the remaining provisions shall nevertheless continue in full force without being impaired or invalidated in any way. The failure of Cobble San Francisco Int'l Co. to insist on strict compliance with any of the terms, covenants, or conditions of this agreement by the other party shall not be deemed a waiver of that term, covenant, or condition, nor shall any waiver or relinquishment of that right or power for all or any other items. Any modification of this agreement will be effective only if it is in writing and signed by the party to be charged.

    The contents of the website and catalogue, such as text, graphics, images and other material ('material'), are protected by copyright under both usa and foreign laws. The use of the website and the material is at your own risk. Changes are periodically made to the website and may be made at any time.
